b. This Policy describes how We use information received about You when You visit Our Site or when You register to, or otherwise use Our online services. This Policy does not cover any information that We may receive from or about You through channels other than through the use of the Site.
2. REVISIONS TO THIS POLICY
We reserve the right to revise, amend, or modify this Policy and Our other policies and agreements at any time and in any manner. You should periodically check for any modifications to this Policy by revisiting this webpage on the Site. You should note the date of last revision, which is labeled as the "Last Modified" date and appears at the top of this Policy. A changed "Last Modified" date indicates that this Policy has been updated or edited, and the updated or edited version supersedes any prior versions immediately upon posting.
3. PERSONAL INFORMATION THAT WE COLLECT
Visitors to Our Site and services will have multiple manners of interactivity with Us. Depending upon Your level of interaction, We will collect different information about You. The type of information collected is as follows:
i. Viewer Member(s) - Upon registering as a Viewer of the Site, We will require Your legal name, date of birth, physical address, a valid email address and telephone number, and any billing information deemed necessary by Our third party payment processor. All billing information provided at registration, or at any time during Your membership, is submitted and retained via a third party payment processing agent only. The sole exception to this data retention policy is the expiration date and last four digits of the account number of the Viewer’s designated payment method, which We retain for fraud prevention purposes pursuant to Our data security provisions set forth in Section 10. We reserve the right, within Our sole discretion, to request additional documentation of identity and/or verification of payment method at any time.
ii. Chathost Member(s) - Upon registering as a Chathost of the Site, We will require Your legal name, date of birth, physical address, a valid email address and telephone number, documentation of a government-issued form of identification, any entertainment industry alias(es), valid electronic payment transfer or digital wallet account information, and any additional information We deem necessary in creating a Chathost account. We reserve the right, within Our sole discretion, to request additional age verification or documentation of identity.
b. Visitors - Visitors are those Users who access the Site, but never enter into any active data collection pages. Any information gathered from Visitors is also gathered from Members. This information is limited to passive information gathering devices like cookies.
4. HOW WE COLLECT INFORMATION FROM YOU
b. Active Collection - We actively collect information from You when You complete the initial Member registration to Our Site, as well as Member account updates via online form and/or email request submission(s).
5. HOW WE USE YOUR INFORMATION
The primary use for Your information is to provide You with services You have requested, or deliver customized services to You. Non-personal and cumulative information, such as that collected passively is used for fraud prevention, and/or research and development purposes, like improving customer support features, Site performance and overall User experience. Actively collected information is generally used for the purpose(s) for which You provided it, for example, creating a Viewer or Chathost account, or ensuring payment for Member services.
6. TRACKING DISCLOSURE
Do Not Track ("DNT") settings are privacy preferences that Users can set in their web browsers. Currently, We do not recognize or respond to web browser DNT signals. For more information about browser tracking signals and Do Not Track policies, please visit: www.allaboutdnt.org.
7. THIRD PARTY DATA TRACKING
We may allow third party services (e.g.: analytics programs; advertising networks) to display and/or track various promotional material on Our Site. We do not provide any personally identifying information to such third parties, but they may use passive tracking technology to collect generalized User activity data from You. The collection and use of such User data may be subject to the policies of the relevant third party. 8. SPECIAL CASES
is Our policy not to use or share the personal information about Visitors or Members in ways unrelated to those described in this Policy without also providing You an opportunity to opt-out or otherwise prohibit such unrelated uses. However, We may disclose personal information about Visitors or Members, or information regarding Your use of the services or websites accessible through Our services, for any reason if, in Our sole discretion, We believe that it is reasonable to do so, including, but not limited to the following circumstances:
a. To satisfy any laws, such as the Electronic Communications Privacy Act, regulations, or governmental, or legal requests for such information.
b. To disclose information that is necessary to identify, contact, or bring legal action against someone who may be violating Our Terms of Service, or other Site policies.
c. To properly operate Our Site and/or services.
d. To protect Ourselves, Our Members, and the general public. We will make all reasonable efforts to cooperate with law enforcement, legal authorities, and governmental administrative or regulatory agencies when legally compelled or advised to do so. We specifically reserve the right to disclose any and all information to law enforcement in the event that a crime is attempted, suspected, or committed, or if We are compelled to do so by lawful criminal, civil, or administrative process, discovery requests, subpoenas, court orders, writs, or reasonable request of authorities or persons with the reasonable power to obtain such process. Private-party litigants will not be cooperated with unless We are legally compelled to do so. Investigative reporters or journalists will never be cooperated with regarding Your personal information unless We are legally compelled to do so.
e. If We have reason to believe that a User has attempted, or committed fraud, or any form of fraudulent activity via the Site and/or services.
9. TRANSMITTALS FROM US
a. We may send You periodic announcements including the details of Our existing and new products and/or services. You may opt-out of these announcements by accessing the unsubscribe link contained in the email transmittal, or by contacting Customer Support at: email@example.com. If You opt out of these marketing emails, You may still receive administrative messages, system notices and other information related to Your membership, or purchase transactions associated with Your account.
b. If You provide Your information to Us, use the Site, or register as a Member, You will have created a commercial relationship with Us. In having done so, You understand that even unsolicited commercial email sent from Us, or Our affiliates, is not SPAM as that term is defined under the law.
10. FORUMS; CHATROOMS; COMMUNICATION FEATURES
We currently provide services that allow Members the ability to communicate via the Site’s various interactive features. Any and all information provided in a forum, group chat/message board, Member profile, Member directory, instant message, text chat session, or other related service should immediately be considered public information. We do not, cannot, and will not act to maintain the privacy of any information that You disclose, publish, or otherwise transmit using Our Site or any such communication feature.
11. OUR COMMITMENT TO DATA SECURITY
We take various measures to protect the transmission of all sensitive User information, and to ensure the integrity and security of Our network and systems. Please note that any actively collected and/or personally identifying information is permanently retained on Our secure in-house database. Nevertheless, We cannot guarantee that Our security measures will prevent third-party ‘hackers’ from illegally obtaining this information. We take all reasonable measures to prevent breaches of security, but are unable to guarantee breach-proof data security. You assume the risk of such breaches to the extent that they occur despite Our reasonable security measures.
12. HOW TO ACCESS YOUR INFORMATION
